This Privacy Policy applies to information we collect when you use our websites, or when you otherwise interact with us.
This privacy policy applies to all services provided by LAMARK SAS (LAMARK) and in particular the imatag.com website (IMATAG). It also applies to other LAMARK websites (lamark.fr and lamark.io) and to and to any other service provided by LAMARK, via API, upload services, etc.
There are three general categories of information we collect.
We ask for and collect the following personal information about you when you use the IMATAG website. This information is necessary for the adequate performance of the contract between you and us and to allow us to comply with our legal obligations. Without it, we may not be able to provide you with all the requested services.
Account Information. When you sign up for an IMATAG account, we require certain information such as your first name, last name, and email address.
Billing Information. If you subscribe to IMATAG Premium, we need some information in order to bill you in particular a billing name and address.
Communications with IMATAG or lamark. When you communicate with us via email or use the forms our our websites, we collect information about your communication and any information you choose to provide.
Communications with other IMATAG users such a likes, sharings, sharing messages and any other interactions between IMATAG users
You may choose to provide us with additional personal information in order to obtain a better user experience when using IMATAG. This additional information will be processed based on your consent.
User settings such as preferred language and notification preferences
Portfolio (public profile) information. i.e. social media profile links, avatar, text content for portfolio and series
Photos and other images or visual content uploaded on the IMATAG website or via our APIs
Photo metadata included in said images at upload time and any updates made on IMATAG
Other Information you may otherwise choose to provide when you fill in a form, conduct a search, update or add information to your IMATAG account, respond to surveys, participate in promotions, or use other IMATAG features.
When you use IMATAG, we automatically collect information, including personal information, about the services you use and how you use them. This information is necessary for the adequate performance of the contract between you and us, to enable us to comply with legal obligations and given our legitimate interest in being able to provide and improve the functionalities of IMATAG.
Usage Information. We collect information about your interactions with IMATAG such as the pages or content you view, your searches, the images you download.
Log Information: We collect log information about how you access or use our services, even if you are not a registered IMATAG user or are not logged-in, including your access times, browser type and language, Internet Protocol (“IP”) address.
Cookies and Similar Technologies: We may automatically collect information using cookies, web beacons (also known as “tracking gifs,” “pixel tags” and “tracking pixels”) and other tracking technologies to, among other things, improve our Services and your experience, monitor user activity, count visits, understand usage and campaign effectiveness, and tell if an email has been opened and acted upon.
Payment Transaction Information. IMATAG collects information related to payment transactions of IMATAG Premium users, including the payment method used, date and time, payment amount, PayPal or Hipay transaction information.
LAMARK may collect information, including personal information, that others provide about you when they use IMATAG, or obtain information from other sources and combine that with information we collect through IMATAG. We do not control, supervise or respond for how the third parties providing your information process your personal data, and any information request regarding the disclosure of your personal information to us should be directed to such third parties.
Images shared with you. When an IMATAG user shares photos with you, whether you are a registered IMATAG user or not, we collect your email address and associate it with the share so we can send you message, add it to the sharer’s address book and provide additional security for the share
Web matches. When we find similarity or certified matches between your images and images found on the web by our robots, we record the match data such as similarity scores and watermark detection results as well as information from the web image and its context which may contain information about you
We use, store, and process information, including personal information, about you to provide, understand, improve and develop IMATAG, improve LAMARK technologies in general and comply with our legal obligations.
Enable you to access and use IMATAG.
Operate, protect, improve, and optimize IMATAG, such as by performing analytics and conducting research.
Conduct R&D to develop new technologies for LAMARK which may or may not be used in IMATAG in the future
Provide customer service.
Send you service or support messages, updates, security alerts, and notifications.
We process this information given our legitimate interest in improving IMATAG and our Members’ experience with it, and where it is necessary for the adequate performance of the contract with you.
Send you promotional messages, marketing and other information for that may be of interest to you.
Personalize, measure, and improve our advertising.
Administer referral programs, rewards, surveys, contests, or other promotional activities or events sponsored or managed by IMATAG or LAMARK.
We will process your personal information for the purposes listed in this section given our legitimate interest in undertaking marketing activities to offer you products or services that may be of your interest. You can opt-out of receiving marketing communications from us by following the unsubscribe instructions included in our marketing communications.
Where you have provided consent, we share your information, including personal information, as described at the time of consent, such as when you participate in promotional activities conducted by IMATAG or third parties.
IMATAG lets you publish information, including personal information, that is visible to the general public. For example:
All the information you see on your Portfolio page is publicly visible to all, such as your full name, avatar, text content, and Social Media links
All the images you have added to you portfolio and their associated metadata may be viewed
If you have authorized HD download of you public images, all images from your portfolio may be downloaded in full resolution by anyone
Images shared using the social media buttons on IMATAG may be viewed by anyone with access to the URL
Information you share publicly on IMATAG may be indexed through third party search engines. If you change your public-facing content, these search engines may not update their databases. We do not control the practices of third party search engines, and they may use caches containing your outdated information.
IMATAG lets you share information, including personal information, that is visible to the people you send it to. For example:
If you share an image or images via the sharing and social media tools on IMATAG, all people with access to the generated unique URL will have access to the images and their associated metadata
If you have authorized HD download for this specific sharing, all people with access to the generated unique URL will be able to download the images in full resolution
LAMARK may disclose information, including personal information if we believe that it is reasonably necessary in order to comply with any applicable law, regulation, legal process or governmental request, including to meet national security or law enforcement requirements
LAMARK reserves the right to access and transmit information, including personal information to the relevant authorities if we believe that disclosure is reasonably necessary to enforce our agreements, policies, and Terms of Use to protect the security or integrity of our services; or to protect LAMARK, our users or the public from harm or illegal activities.
If LAMARK undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer or share some or all of our assets, including your information in connection with such transaction or in contemplation of such transaction (e.g., due diligence). In this event, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.
We may also share aggregated information (information about our users that we combine together so that it no longer identifies or references an individual user) and other anonymized information for regulatory compliance, industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.
IMATAG and LAMARK uses a variety of third party service providers as data processors. Our service providers are based in the European Economic Area (“EEA”) and the United States. Some of these providers may have limited access to your information, including personal information, to perform these tasks on our behalf, and are contractually bound to protect and to use it only for the purposes for which it was disclosed and consistent with this Privacy Policy.
Our Service Providers based in the European Economic Area (“EEA”) apply the General Data Protection Regulation (GDPR) as required by law. They may help us:
allow the provision of the IMATAG services through third party platforms and software tools (e.g. through the integration with our APIs)
host the IMATAG servers and other servers used by LAMARK websites and services (service provider may not access or process data unless required to do so)
Our Service Providers based in the United States all conform to the EU-US Privacy Shield Framework and have GDPR compliant privacy policies. They may help us:
provide electronic messaging services
provide CRM and mailing services
provide anonymized website usage analysis (no personal information is processed or stored)
provide image processing services (images sent are anonymized unless the images themselves contain personal information)

In accordance to regulation and to prevent abuses, you must include a proof of identity with your request.
IMATAG users may also exercise those rights by sending an email to privacy@imatag.com. This method is for convenience but does not constitute a formal channel. We reserve the rights to ignore email requests from unknown addresses and which do not include sufficient proof of identity.
You may access and update some of your information through your account settings or your Portfolio page. You are responsible for keeping your personal information up-to-date.
You may ask us to correct inaccurate or incomplete personal information concerning you and which you cannot update yourself within your IMATAG account.
You may request copies of your personal information held by us.
You may also request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format and/or request us to transmit this information to another service provider (where technically feasible).
We generally retain your personal information for as long as is necessary for the performance of the contract between you and us and to comply with our legal obligations. If you no longer want us to use your information to provide the IMATAG services to you, you can request that we erase your personal information and close your IMATAG account. Please note that if you request the erasure of your personal information:
We may retain some of your personal information as necessary for our legitimate business interests, such as fraud detection and prevention. For example, if we suspend an IMATAG account for fraud, we may retain certain information from that IMATAG account to prevent that user from opening a new IMATAG account in the future.
We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, LAMARK may keep some of your information for tax, legal reporting and auditing obligations.
Some copies of your information (e.g., log records) may remain in our database, but are disassociated from personal identifiers.
Because we maintain the IMATAG to protect from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period of time.
LAMARK will provide access to the data associated with the deactivated account upon receipt of the required legal documentation.
We are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorized access, loss, destruction, or alteration. Some of the safeguards we use to protect your information are firewalls and data encryption, and information access controls. If you know or have reason to believe that your IMATAG account credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of your IMATAG account, please contact us following the instructions in the Contact Us section below.
LAMARK reserves the right to modify this Privacy Policy at any time. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice by sending you an email notification.
While we will notify you of any material changes to this Privacy Policy, we encourage you to review this Privacy Policy periodically.
